These Terms of Service ("Terms") govern your use of the ECG Tracker+ mobile application (the "App") and related services provided by Artur Teodorowicz ("we", "us", "our"), an individual entrepreneur operating in Poland. By downloading, accessing, or using the App, you agree to these Terms.
1. Medical disclaimer; not for emergencies
- The App is provided for informational and organizational purposes only and is not a medical device.
- The App does not provide diagnosis, treatment recommendations, or medical advice.
- Do not use the App for emergency situations. If you believe you may be experiencing a medical emergency, call your local emergency number.
- You are solely responsible for how you use information displayed or generated by the App.
2. Eligibility
You must be at least 13 years old (or the minimum age required by your jurisdiction) to use the App.
3. Your content and data
- You retain ownership of ECG data, notes, and other content you import into or create in the App.
- You are responsible for ensuring you have the rights to use and share any data you upload, export, or share.
- If you export or share reports (for example PDFs), you understand they may contain sensitive health-related information and you do so at your own discretion.
4. License and acceptable use
- We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
- You may not copy, modify, distribute, sell, rent, lease, lend, or sublicense the App except as permitted by law.
- You may not reverse engineer, decompile, or attempt to derive source code from the App except where such restriction is prohibited by law.
- You may not use the App in a way that violates law, infringes rights, interferes with the App, or attempts to gain unauthorized access to systems or data.
5. Subscriptions and payments
- Certain features may require a paid subscription.
- Subscriptions are billed and managed by Apple through your App Store account (auto-renewing unless canceled).
- You can manage or cancel subscriptions in your Apple ID settings. Refund requests are handled by Apple under their policies.
- We use RevenueCat to help validate subscription status and manage entitlements.
6. Third-party services and SDKs
The App relies on third-party platforms and services. Your use of those services may be governed by their own terms and privacy policies.
- Apple Health/HealthKit: used to import ECG records from Apple Health (with your permission).
- RevenueCat: used to manage subscription entitlements and validate purchase status.
- TelemetryDeck: used for privacy-focused analytics to improve the App.
- Sentry: used for crash reporting and diagnostics to improve stability.
7. Privacy
Our Privacy Policy describes how we process information. By using the App, you agree to our Privacy Policy.
8. Changes, availability, and termination
- We may update the App or change features at any time. We may also suspend or discontinue the App, in whole or in part.
- We may suspend or terminate your access if you materially violate these Terms.
- You may stop using the App at any time and can delete data from within the App or by uninstalling it.
9. Disclaimers
To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenues, arising from or related to your use of (or inability to use) the App.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.
11. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the App or your violation of these Terms.
12. Governing law
These Terms are governed by the laws of Poland, without regard to conflict-of-laws rules. Mandatory consumer protection rules in your country of residence may also apply.
13. Apple App Store terms
- These Terms are between you and us, not Apple.
- Apple has no responsibility for the App or its content, except as required by applicable law.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation.
